13 November: Application filed in the Federal Court
Friends of Leadbeater’s Possum’s seeks –
* an injunction to prevent VicForests from logging other than in accordance with the RFA
* an order to protect forests from logging to mitigate the significant impact of past logging on the Greater Glider
* an order to protect forests from logging to mitigate the significant impact of past logging on the Leadbeater’s Possum
* an interim injunction to prevent logging in the 34 listed coupes until further order
17 November: Interlocutory hearing
The Court ordered that a hearing should be held in relation to a “separate question” on 14-15 December. The “separate question” concerns whether or not logging operations named in the claim are being conducted in accordance with the RFA, and are exempt from the EPBC Act requirements for assessment and approval of actions that significantly impact threatened species (see Federal Court for the full text of the “separate question” and other orders made by Justice Mortimer).
The Court orders also record that VicForests will not log in 34 scheduled coupes (see paragraph 10 of the statement of claim), until the separate question has been determined by the Court.
The Case returns to Court on 14th December to hear the “separate question”.
